END USER LICENSE AGREEMENT (EULA) FOR SMASH GAME STUDIOS LLP GAMES

IMPORTANT: PLEASE READ CAREFULLY BEFORE INSTALLING OR USING OUR GAMES. THIS END USER LICENSE AGREEMENT (EULA) IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) AND SMASH GAME STUDIOS LLP ("THE COMPANY," "WE," OR "US") FOR THE USE OF OUR GAMES. BY INSTALLING, COPYING, OR OTHERWISE USING THE GAMES, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE GAMES.

LICENSE GRANT: Smash Game Studios LLP grants you a non-exclusive, non-transferable, revocable, limited license to install and use our games for personal and non-commercial purposes on compatible devices you own or control, subject to the terms and conditions of this EULA.
INTELLECTUAL PROPERTY: All titles, content, trademarks, logos, artwork, and intellectual property rights associated with the games are the sole property of Smash Game Studios LLP and its licensors. This EULA does not grant you any ownership rights to the games.
RESTRICTIONS: You may not: (a) modify, distribute, transmit, publicly display, or create derivative works based on the games; (b) reverse engineer, decompile, or disassemble any part of the games; (c) remove or alter any proprietary notices or labels on the games; (d) use the games for any unlawful, harmful, or unauthorized purpose; (e) use the games to infringe upon the rights of others; (f) sublicense, lease, rent, or otherwise transfer the games to any third party.
ACCOUNTS AND DATA: Some of our games may require you to create an account to access certain features or services. You are responsible for maintaining the confidentiality of your account information and are liable for all activities that occur under your account. You agree to provide accurate and complete information when creating your account. We may collect and process certain personal data as described in our Privacy Policy, available on our website.
IN-GAME PURCHASES: Our games may include optional in-game purchases that offer virtual goods or currency. These purchases are entirely voluntary, and you can still enjoy the games without making any purchases. By making in-game purchases, you agree to pay the associated fees and abide by the relevant payment terms. All purchases are final, non-refundable, and non-transferable.
UPDATES AND CHANGES: Smash Game Studios LLP may release updates, patches, or new versions of the games from time to time. You agree that the games may automatically download and install updates, and you consent to such updates being installed on your device.
TERMINATION: This EULA is effective until terminated by either party. You may terminate this EULA by uninstalling the games and deleting all copies in your possession. Smash Game Studios LLP may terminate this EULA at any time if you violate its terms. Upon termination, you must immediately cease all use of the games and delete all copies in your possession.
DISCLAIMER OF WARRANTIES: THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
LIMITATION OF LIABILITY: SMASH GAME STUDIOS LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE GAMES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SMASH GAME STUDIOS LLP'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE GAMES.
GOVERNING LAW: This EULA shall be governed by and construed in accordance with the laws of India, without regard to its conflicts of law principles.
ENTIRE AGREEMENT: This EULA constitutes the entire agreement between you and Smash Game Studios LLP concerning the games and supersedes all prior or contemporaneous representations, understandings, or agreements.
